Twin Cities Wrongful Death Attorney

Minneapolis St Paul Twin Cities Attorney Kenneth LaBore

For three decades Twin Cities Wrongful Death Attorney Kenneth LaBore has been representing the families of victims of neglect resulting in death. Unfortunately, there are many ways that negligence taken the life of others. I have handled hundreds of wrongful death cases resulting from accidents such: as automobile, ATV, boating, swimming pools, fires, product liability, building construction, medical malpractice and elder abuse and neglect.

I know it is important for families to get information about the incident and accountability from those responsible. Unlike other cases wrongful death claims have requirements to ensure the rights of the next of kin are protected. To prevail on a claim a party must establish the elements that there was a duty to the injured or deceased party, that the defendant breached their duty (was negligent), that the negligence was the cause of injury, and the injury was the cause of the death. Most often the case involves independent expert testimony to show the duty and breach and different experts on the injury and cause of death.

Minnesota law was changed in 2003 to allow for pain and suffering and all legal damages resulting from the death due to negligence. Minnesota Stat. 573.02, Subd. 1, sets for the damages allowable under law. The recovery in the action is the amount the jury deems fair and just for all damages suffered by the decedent resulting from the injury prior to the decedent’s death and the pecuniary loss resulting from the death, and shall be for the exclusive benefit of the surviving spouse and next of kin, proportionate to the pecuniary loss severally suffered by the death.
